DRLA helps client fight eviction due to lack of basic services 


A client, Mr A*., reached out to DRLA for legal assistance because he was being evicted from his federally subsidized apartment for failing to keep it clean. A once successful professional, Mr. A suffered from a stroke in 2013, which left half of his body paralyzed and made ordinary tasks, such as cleaning, a major challenge. Mr. A was apparently eligible and in need of basic services, yet he was receiving little to none. On Mr. A’s behalf, a DRLA attorney spoke with his property manager about providing reasonable accommodation, available services to assist with cleaning, and withdrawing the eviction. There was initial agreement; however, the eviction moved forward because the regional supervisor did not trust that Mr. A would continue to receive services and be able to maintain his home. It was further suggested that Mr. A’s personal hygiene was reason enough for eviction.

DRLA’s attorney requested a meeting from the regional supervisor and a lively discussion which included the supervisor, property manager, a member of their board, DRLA’s Managing Attorney, and Mr. A’s cousin, took place via Zoom. With federal anti-discrimination laws on our side, rallied support from family members, a services provider lined up, and proof that Mr. A’s apartment was clean, the board agreed to withdraw the eviction, and the eviction was in fact withdrawn.
